NOWScout’s WAIVER

NOWSCOUTS PREPAREDNESS & RESILIENCY MENTORSHIP PROGRAM ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT (State of North Carolina)

1. Nature of the Program

The NOWScouts Preparedness & Resiliency Mentorship Program (the “Program”) provides structured mentorship and training for males ages 11 and older in outdoor preparedness, resiliency, and austere-environment skills. Activities may include, but are not limited to: rappelling and rope operations; land navigation (day and night); swift-water and stream crossings; camping and wilderness survival; food preparation and fire building; water procurement and purification; basic medical training and first aid; operation of machinery and hand tools; operation of forestry and land-clearing equipment; and general operations within wooded, uneven, and remote terrain. Activities may occur in remote environments where medical care may not be immediately available.

2. Assumption of Inherent Risks

I acknowledge that participation involves inherent risks, including but not limited to falls, drowning, cuts, burns, fractures, sprains, equipment malfunction, weather exposure, wildlife encounters, dehydration, illness, serious bodily injury, permanent disability, and death. I understand that these risks cannot be eliminated without fundamentally altering the nature of the Program. I voluntarily and knowingly assume all risks, both known and unknown, even if arising from the negligence of the Released Parties (defined below), to the fullest extent permitted under North Carolina law.

3. Release and Waiver of Liability (North Carolina)

In consideration of being permitted to participate, I, on behalf of myself and/or my minor child, hereby release, waive, discharge, and covenant not to sue NOWScouts, International Network of Tailored Aid (INTA), its officers, directors, instructors, mentors, volunteers, agents, affiliated organizations, property owners, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, costs, or liabilities arising out of or relating to participation in the Program, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent allowed under North Carolina law.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including attorney’s fees, that may arise due to participation in the Program, whether caused by negligence or otherwise. 5. Medical Authorization and Responsibility I certify that the participant is physically fit to participate and has no condition that would prevent safe involvement. I authorize Program staff to obtain emergency medical care if deemed necessary. I understand that I am solely responsible for all medical expenses incurred.

6. Parental Consent (Required for Participants Under 18)

As the parent/legal guardian of the above-named minor, I consent to his participation and agree to all terms of this Agreement on his behalf. I understand that North Carolina law may limit the enforceability of certain waivers signed on behalf of minors; however, I intend this Agreement to be as broad and inclusive as permitted by law.

7. Governing Law and Venue

This Agreement shall be governed by and construed under the laws of the State of North Carolina. Any dispute shall be brought exclusively in a court of competent jurisdiction within North Carolina. 8. Severability If any portion of this Agreement is held invalid, the remainder shall continue in full legal force and effect.
